Agreement
These terms are an agreement between you and Maryan Mandziuk, an individual based in Ukraine (“GameContour”, “we”, “us”), who runs GameContour at gamecontour.com and app.gamecontour.com (the “service”).
By creating an account or using the service, you agree to these terms and to the privacy policy. If you use GameContour for a company, you confirm that you can accept these terms for it, and “you” includes that company. If you do not agree, do not use the service.
YouTube Terms of Service
GameContour uses YouTube API Services. By using GameContour, you agree to be bound by the YouTube Terms of Service. Google’s use of data is covered by the Google Privacy Policy.
GameContour is not made, endorsed or sponsored by YouTube, Google or Valve. YouTube is a trademark of Google LLC, and Steam is a trademark of Valve Corporation.
Your account
- You must be at least 16 years old to use GameContour.
- Give accurate details when you sign up, and keep them up to date.
- You are responsible for what happens under your account. Keep your password safe, and tell us at once if you think someone else has used your account.
- If you sign in with Google, your use of Google sign-in is also covered by Google’s terms. You can remove GameContour’s access from your Google account at any time.
- One account is for one person. Do not share your sign-in with others.
The service and its data
GameContour collects public information about videos from YouTube gaming channels, matches each video to a Steam game, and combines view counts across all the channels it tracks into metrics for each game, genre and Steam tag, to show how attention changes over time.
- These combined metrics are GameContour’s own calculations, not figures published or endorsed by YouTube.
- The numbers cover the channels we track, not all of YouTube, and video matching is automatic. Figures can be incomplete, delayed or wrong.
- GameContour is information, not advice. You are responsible for decisions you make with it, such as signing, funding or marketing a game.
- We may add, change or remove features, and may pause the service for maintenance. We try to give notice of changes that matter to you.
Acceptable use
When you use GameContour, you must not:
- scrape, crawl or bulk download data from the service;
- resell, sublicense or republish GameContour data as a dataset or a competing product;
- copy, decompile or reverse engineer the service, except where the law allows it;
- get around access limits, test its security without our written permission, or overload it;
- use the service in a way that breaks the law, these terms or the YouTube Terms of Service;
- use GameContour data to harass, spam or mislead content creators or anyone else.
You may use what you see in GameContour in your own work, such as internal reports and presentations, and quote small amounts publicly if you name GameContour as the source.
Third-party content
Video titles, thumbnails, channel names and game information belong to their owners, such as the creators, YouTube, Valve and game publishers. GameContour shows them to describe and link to the original content. Links to YouTube, Steam and other sites are governed by those sites’ terms.
If you believe content in GameContour infringes your rights, email mandzyuk.maryan@gmail.com and we will review it promptly.
Fees
GameContour is free to use while it is in early access. If we introduce paid plans, we will tell you the prices and terms before anything is charged, and you choose whether to subscribe.
Ownership and licence
The service, including its software, design, analysis and compiled data, belongs to us. While you follow these terms, we give you a personal, non-exclusive, non-transferable right to use it.
If you send us feedback or ideas, we may use them without any obligation to you.
Privacy
How we handle personal data, including data from Google sign-in, is described in the privacy policy.
Ending your use
You can stop using GameContour at any time. To delete your account, email mandzyuk.maryan@gmail.com from the address on your account, and we delete it within 7 days.
We may suspend or close your account if you break these terms, if your use harms the service or others, or if the law requires it. Unless the situation is urgent or the law prevents it, we tell you why first. We may also stop offering GameContour altogether, with at least 30 days’ notice.
The sections on ownership, disclaimers, liability and governing law still apply after your account ends.
Disclaimers
The service is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free or fit for a particular purpose, or that its data is complete or accurate.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost deals or lost data, that come from using or not being able to use GameContour. Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim, or 100 US dollars if you paid nothing.
Nothing in these terms limits liability that cannot be limited by law, such as for fraud or for harm caused on purpose or through gross negligence, or the rights you have as a consumer where you live.
Changes
We may update these terms. When we do, we change the effective date at the top of this page, and we email you about important changes at least 14 days before they take effect. If you keep using GameContour after that, the new terms apply. If you do not agree, you can delete your account.
Governing law
These terms are governed by the laws of Ukraine. Disputes go to the courts of Ukraine, unless the law where you live as a consumer gives you the right to bring them in your own courts. Before going to court, please email us so we can try to settle the issue.
If part of these terms cannot be enforced, the rest still applies.
